Student Assessment
Title I- Part A- Improving Basic Programs Operated by Local Educational Agencies – Subpart 1- Basic Program Requirements--Sec. 1120. Participation of Children in Private Schools—Sec. 1113.
Eligible School Attendance Areas
Title I of NCLB does not require states to assess private school children, as it is not written into the law, it does say that the programs must be re-examined annually through some type of student assessment. The Department of Education states the guidance for assessment of programs:

Should not be always be assessed on the same standards as the state because the private school might have different measures of assessment

The school district with the private school officials must develop alternative standards for assessment

The school district must then state how they are going to use the assessment to improve the Title I programs if the children fail what ever measures they are assessed on

The assessment cannot lead to school improvement sanctions, only program improvements

*The children in Title I programs can be assessed on the same standards as public school children (as defined in Sec. 1111 of Title I), but only after consultation with the private schools.
