Title V- Sec. 5142- Participation of Children Enrolled in Private Schools

 
1. Educational services and other benefits for private school children in one district shall be EQUITABLE in comparison to services and other benefits for public school children in that same district.
 
2. Expenditures for educational services and other benefits to eligible private school children shall be equal to the proportion of funds allocated to participating school attendance areas based on the number of children from low-income families who attend private schools, which the local educational agency may determine each year or every 2 years.
 
3. The control of the funds is under the public agency, or LEA, not the private institution, and they should administer such funds, materials, equipment, and property.
 
4. Services provided under this part shall be provided by employees of a public agency or through contract by such a public agency with a person, association, agency, or corporation that, in the provision of such services, is independent of the private school and of any religious organizations, and such employment or contract shall be under the control and supervision of such a public agency that represents that particular school district.
